These Terms of Service govern your use of The Old Kitbag website and any purchases made through our online store.
Please read these terms carefully before placing an order.
By using our website or placing an order with us, you agree to these Terms of Service. Nothing in these terms affects your statutory rights as a consumer.
1. About us
The Old Kitbag is an independent retailer specialising in genuine military surplus, clothing, equipment, headwear, insignia and related items.

We are an independent surplus retailer and are not affiliated with, sponsored by or endorsed by the UK Ministry of Defence or any branch of the UK Armed Forces unless expressly stated otherwise.
We are veteran owned and operated, and are happy to provide proof of service on request.
UK online traders are required to provide customers with identifying and contact information, including a geographical address and email address.
2. Our online store
Our online store is hosted and supported by Shopify.
Shopify provides the ecommerce platform that enables us to display products, receive orders and process transactions.
Your use of certain payment, account or checkout functions may also be subject to terms and privacy policies operated by Shopify or the relevant payment provider.
3. Products
We take reasonable care to ensure that product descriptions, photographs, sizes, condition grades and other information displayed on our website are accurate.
However, much of our stock consists of genuine military surplus.
Unless an item is expressly described as new, unused or unissued, surplus products may have previously been issued, stored or used.
Depending upon the condition stated in the listing, reasonable characteristics of surplus goods may include:
- signs of previous wear or laundering;
- fading or colour variation;
- service or ownership markings;
- minor marks;
- minor cosmetic wear;
- variations between manufacturers or production batches;
- replacement buttons or fittings;
- minor wear to zips, fasteners or hardware; and
- other characteristics consistent with genuine surplus use.
Any significant defect known to us that is not reasonably expected from the advertised condition will be described where appropriate.
The fact that goods are used or military surplus does not remove your statutory rights. Goods supplied to consumers must still meet the requirements of the Consumer Rights Act 2015, including being of satisfactory quality, fit for any particular purpose made known to us where applicable, and as described.
4. Military sizing
Military clothing frequently uses service sizing systems rather than conventional UK retail sizes.
For example, an item may be marked using measurements such as:
80/84/100
rather than Small, Medium or Large.
Where possible, we will provide sizing information or guidance to help customers understand these markings.
Any conversion into conventional sizes such as Small, Medium or Large should be regarded as guidance unless expressly stated otherwise.
Customers should check the listed military measurements and any measurements provided in the product description before ordering.
This does not affect your rights where an item supplied is materially different from its description.
5. Product photographs
We aim to use photographs that represent the product accurately.
Where we have multiple substantially equivalent surplus items of the same type, size and grade, photographs may occasionally be representative of the stock rather than the exact individual item received. Where individual condition varies materially, we will aim to make this clear in the listing.
Colours may also appear slightly different depending on lighting, photography and the display settings of your device.
Where an item is individually collectible, unusual or sold because of particular markings or features, the product listing should identify whether the photographs show the actual item being sold.
6. Prices
Prices are shown in pounds sterling (£ GBP) unless otherwise stated.
The price payable is the price shown at checkout at the time the order is placed, together with any applicable delivery charges.
Any taxes that we are legally required to charge will be included or displayed as required.
Delivery charges will be shown before you place your order.
UK distance-selling rules require traders to make the total price, delivery costs and payment arrangements clear before a customer enters into the contract.
7. Pricing and listing errors
We make reasonable efforts to ensure prices and product information are correct.
Occasionally, an obvious pricing, stock or listing error may occur.
If we identify a material error affecting your order, we will contact you as soon as reasonably possible.
Where we cannot fulfil the order as advertised, we may cancel the affected item or order and refund any amount paid for it.
We will not substitute a materially different product without your agreement.
8. Placing an order
When you submit an order through our website, you are requesting to purchase the goods shown in your basket at the displayed price.
After successfully placing an order, you will receive an electronic order confirmation.
Please check your confirmation carefully, particularly:
- product;
- size;
- quantity;
- delivery address; and
- delivery method.
If anything is incorrect, contact us at customerservice@theoldkitbag.co.uk as soon as possible.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- an item is no longer available;
- there has been a material pricing or listing error;
- payment has not been authorised;
- we reasonably suspect fraud or misuse of the website;
- we are legally prohibited from supplying the goods; or
- we are unable to deliver to the supplied address.
Where we cancel an order after taking payment, the amount paid for the cancelled goods will be refunded.
9. Payment
Payment must be made using one of the payment methods offered at checkout.
Payment services may be provided by Shopify Payments, PayPal or another payment provider made available through the store.
You must be authorised to use the payment method supplied.
We do not require customers to send payment card details to us by email.
10. Availability
Military surplus is inherently limited and many products cannot be readily replaced once sold.
All products are therefore subject to availability.
An item appearing on the website does not guarantee that stock will remain available until checkout has been completed.
Where an ordered product unexpectedly becomes unavailable, we will contact you and provide an appropriate refund for the affected item.
11. Delivery
Available delivery services and their prices will be shown during checkout.
You are responsible for providing a complete and accurate delivery address.
We will make reasonable efforts to dispatch orders within any timescale stated on our website.
Unless a different delivery period has been agreed, UK consumer rules generally require goods to be delivered without undue delay and no later than 30 days after the contract is made.
Delivery estimates supplied by carriers are estimates unless we expressly guarantee a particular service.
If we become aware of a significant delay, we will take reasonable steps to inform you.
12. Risk in the goods
For consumer orders, responsibility for the goods remains with us while they are being delivered by a carrier we have arranged.
Risk generally passes to you when you, or a person you have nominated, physically receives the goods.
This reflects section 29 of the Consumer Rights Act 2015, under which goods normally remain at the trader's risk until they come into the physical possession of the consumer or their nominated recipient.
13. Cancellation and change-of-mind returns
Consumers purchasing online normally have a statutory right to cancel qualifying purchases.
For most goods, the cancellation period is 14 days beginning after the goods are received.

Nothing in these terms limits any cancellation right provided by law.
14. Faulty or misdescribed goods
Your statutory rights are separate from your right to change your mind.
Goods supplied to consumers must comply with the Consumer Rights Act 2015.
Among other requirements, goods must be:
of satisfactory quality;
fit for purpose where applicable; and
as described.
Consumers can have statutory remedies where goods fail to meet these requirements, including circumstances in which the short-term right to reject applies.
Nothing in these Terms of Service or our Return & Refund Policy excludes or restricts those rights.
15. Grade and condition descriptions
Where we use condition terminology such as:
New / Unissued
Like New
Grade 1
Grade 2
Un-Serviceable
the meaning will be determined by the description provided on the relevant product page and any condition guide published by us.
Condition grading is intended to provide customers with a practical indication of the item's cosmetic and functional condition.
Because genuine surplus items may vary, two products carrying the same grade need not be cosmetically identical.
A condition grade does not override specific statements or photographs contained within the individual product listing.
16. Returns of surplus goods
Normal and clearly disclosed characteristics of a used surplus product are not necessarily defects simply because the item is not cosmetically equivalent to a new retail product.
For example, where a garment is expressly sold as used and its description states that minor fading and previous service markings may be present, the mere presence of such disclosed characteristics will not ordinarily mean the product differs from its description.
However, nothing in this section excludes liability for goods that do not conform to the contract or attempts to remove your statutory rights.
17. Promotions and discount codes
From time to time we may offer:
- discount codes;
- bundle offers;
- promotional prices;
- free delivery offers; or
- other promotions.
Individual promotions may be subject to additional conditions.
Unless stated otherwise:
- discount codes cannot be exchanged for cash;
- only one discount code may be used per order;
- promotions may have an expiry date;
- discounts apply only to eligible products; and
- we may withdraw a promotion before an order is placed.
Withdrawal of a promotion will not affect an order already completed on the agreed promotional terms.
18. Store credit and gift cards
Where store credit or gift cards are available, they may be subject to additional conditions displayed when they are issued or purchased.
Store credit offered voluntarily does not replace a cash or original-payment-method refund where the customer has a legal entitlement to such a refund and has not agreed otherwise.
19. Customer accounts
You may have the option to create or access a customer account.
You are responsible for ensuring that the information associated with your account is accurate.
You must not use another person's account without their authority.
We may restrict or disable access where reasonably necessary to protect customers, the business or the security of the website.
20. Acceptable use
You must not use our website:
- unlawfully or fraudulently;
- to interfere with the operation or security of the website;
- to introduce malicious software or code;
- to attempt unauthorised access to systems or accounts;
- to impersonate another person;
- to submit false payment or delivery information; or
- in any way that infringes the rights of another person.
We may restrict access where reasonably necessary to prevent fraud, abuse or security threats.
21. Intellectual property
Unless otherwise stated, the content created by The Old Kitbag for this website — including our original photographs, written product descriptions, branding, graphics and other original material — belongs to us or is used with permission.
You may use the website for personal shopping purposes.
You must not reproduce our original website content for commercial purposes without permission, except where permitted by law.
Third-party names, trademarks, military insignia and other protected material remain the property of their respective owners.
22. Third-party services and links
Our website may contain links to or integrations with third parties, including payment providers, delivery companies, social-media platforms and other services.
We are not responsible for the content or operation of independent third-party websites.
Your use of those services may be governed by the third party's own terms.
This section does not affect our responsibilities to you for services or delivery arrangements for which we remain legally responsible.

Where cookies or similar technologies are used, further information may also be provided through our cookie settings or cookie policy.
24. Our liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms of Service excludes or restricts any liability or consumer right that cannot legally be excluded or restricted.
If you are purchasing as a consumer, these terms do not affect your statutory rights.
We are not responsible for losses that were not reasonably foreseeable when the contract was made, except where the law provides otherwise.
Nothing in this section is intended to exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
25. Business purchases
These Terms of Service are principally written for sales to consumers.
If you purchase goods wholly or mainly for the purposes of a trade, business, craft or profession, different statutory rights may apply.
If we introduce dedicated trade or wholesale sales in future, additional trade terms may apply and will be identified before an order is placed.

The terms that apply to an individual purchase will be those applicable when the order is made, unless a change is required by law.
The latest version will be displayed on this website with its updated date.
28. Severability
If any provision of these terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
29. Governing law
These terms are governed by the applicable laws of Scotland, subject to any mandatory consumer protections that apply to you.
If you are a consumer resident elsewhere in the United Kingdom, nothing in these terms deprives you of mandatory protections available to you under the laws applicable where you live.
